    A common press release of the Calla Association, the South Bohemian Mothers and the Environmental Law

    Although the planning procedure for the construction of an 18-hole golf course on Podskalská louka was closed, groundwork is still in progress on the site! The fact that it is not just ”soil improvement groundwork” but unlawful construction of an 18-hole golf course was confirmed by an expert opinion given by Dr. Božena Šerá, Institute of Landscape Ecology, Czech Academy of Sciences. The Environmental Law Service in Tábor, which gives the Calla Association and South Bohemian Mothers legal help in cases exceeding common proceedings, commissioned the opinion for the needs of these associations. The opinion answered these basic questions: * The groundwork, based on a subsoil change and on a drainage system installation, is not a construction according to the building act but it still requires a planning licence as it fundamentally changes the appearance of the surroundings and the drainage circumstances. The Hluboká nad Vltavou building authority violated the building act by not conducting the building permit procedure! * The groundwork is being conducted on land that was removed from the agricultural land resources and is not a standard cultivation procedure. The landowner ing. P?r’s justification that this procedure will improve the soil structures and will increase the grass growth yield is thus deliberately untruthful. * The groundwork localities basically copy planned putting greens and it is possible to characterize them as the beginning of groundwork construction. * The negative influence on old oaks cannot be entirely eliminated owing to a drainage system installation. * The groundwork is being conducted in the protection zones of some old trees, which is prohibited by law. * The groundwork will influence the stability of natural communities in the given localities. * The groundwork could blemish the landscape character of Podskalská louka and Po?í?ská louka. The associations will transfer the expert opinion to the Ministry of Environment and to the ombudsman. Owing to the fact that these comments raised by civic associations, Agency for Nature Conservation and Landscape Protection and Czech Environmental Inspection were not taken into account and clarified in the present round of proceedings, the expert opinion will be used for the appeal proceedings led by the Ministry of Environment. The associations are, in the next few days, going to approach the ombudsman to initiate an investigation of the unlawful practice of the ?eské Bud?jovice district authority and Hluboká nad Vltavou building authority.
